Charter Township of AuSable 

Meeting called to order at 7:00pm by Supervisor Hayes.

PRESENT:
Reeder, Lamrock, Barnes, Gary, Hayes, and Poland. 

ABSENT:
Beliveau.

STAFF PRESENT:
Superintendent Wilson.

PRESS COVERAGE:
Holly Nelson.

Pledge of Allegiance recited.

AGENDA:
Motion by Gary to adopt the meeting agenda as presented, seconded by Hayes.  On voice vote: All were in favor, motion carried.

PUBLIC COMMENTS:
None.   
 
CONSENT AGENDA:
Motion by Gary, to accept the Consent Agenda, approving the minutes of the Township Board from 01/03/05, reports that included: HSRUA Minutes (12/07/04), OWAA Minutes (11/18/04), WDC (12/02/04 and 12/09/04), Police (December), Water & Sewer (December), Assessor (December), Zoning (December) and authorizing payment of bills for the General, Water, and Sewer Funds, seconded by Lamrock.  Roll call: All yes, motion carried.

UNFINISHED BUSINESS:

PENSION PLAN ORDINANCE #87:
Lamrock made a motion to adopt Ordinance #87, the AuSable Township Pension Plan Ordinance, as previously introduced and published, and to authorize a second publication of the ordinance, indicating that the effective date to be thirty days after publication, seconded by Poland.  Roll call: Hayes: no, all others: yes, motion carried.

SUPERINTENDENT:
Wilson introduced a resolution adopted in January of 1983, which indicated the rules that the Board would use to govern public comment during Board meetings.  Wilson also asked for and received permission to speak with regard to each agenda item before the Board began their own discussion.

ORDINANCE ENFORCEMENT OFFICER ORDINANCE #89:
Gary made a motion to adopt Ordinance #89, an ordinance to create an AuSable Township Ordinance Enforcement Officer, as previously introduced and published, and to authorize a second publication of the ordinance, indicating that the effective date to be thirty days after publication, second by Barnes.  Roll call: All yes, motion carried.




UNFINISHED BUSINESS CONTINUED:

STEPS FOR ENACTING NON-ZONING ORDINANCES-POLICY:
Lamrock made a motion to adopt the steps for enacting non-zoning ordinances as introduced, as a policy, seconded by Hayes.  Roll call: All yes, motion carried.

SHORELINE PARK BEACH SAMPLING COST:
Lamrock made a motion to authorize the Superintendent to write a letter to the Iosco County Health Department indicating that the Township Board supported the testing as a grant program but do not have funds available to contribute to the cost of testing, seconded by Hayes.  Roll call: All yes, motion carried.

FINISH LINE PARK GRANT UPDATE:
Gary updated the Board with regard to significantly disparate appraisals on the Myles property.  The MDNR Grant Office recommended that we seek arbitration and specifically named a Mr. Anthony Piazza as the appraiser/arbitrator to be used.  Mr. Piazza submitted an engagement letter that indicated he would have the work accomplished within 60 days for a sum of $3,000.  Discussion ensued regarding need for the property, values, effort and money already expended, and grant time restrictions.  Lamrock concluded the discussion by offering a motion to authorize the Superintendent to seek a reduction in the time required and to sign the engagement letter, seconded by Barnes.  Roll call: All yes, motion carried.

NEW BUSINESS: 

CORRESPONDENCE:
Charter Communications sent a letter to notify the Township of a rate hike that will take effect during the February cycle for 2005 cable bills.  As an informational item, no action was taken.

BOARD COMMENTS:
Poland and Lamrock thanked Gary for his work on the Finish Line Park Grant, indicating that he was working above and beyond the call of normal trustee duties on this issue. 
 
PUBLIC COMMENTS:
Larry Baldwin thanked the Board for allowing the public to speak during Board meetings.  

The Board also fielded several questions regarding Finish Line Park, costs of the grant process, and the appraisals.

Motion by Lamrock, seconded by Poland to adjourn.
