The Charter Township of AuSable Planning Commission will hold a public hearing on October 21 at 6:00 pm to recommend rezoning of properties to the Township Board. The public hearing will be held at the Township Hall at 4420 N. US 23, AuSable, MI 48750.  The full text of the Zoning Ordinance and map of the proposed rezoning are available at the Township Hall, online at http://www.ausabletownship.net, or by contacting Leisa Sutton at 989-739-9169 or by email at superintendent@ausabletownship.net. Written comments may be sent to the address above prior to the meeting.  The public may appear at the public hearing or by counsel via Zoom. Zoom meeting information will be located on the Township website. The lots proposed for rezoning from C-1 to C-2 and C-1 to R-4 are located in the block bounded by US 23, Lake St, Huron St and Division St and also lots west of US 23 and south of Division.

                PLEASE TAKE NOTICE that the Charter Township of AuSable Planning Commission will conduct a public hearing on October 21, 2020, at 6:00 p.m., at the Charter Township of AuSable Hall, located at 4420 N. US 23, AuSable, Michigan 48750 (phone number: 989-739-9169), for the purpose of considering a proposed amendment to the Charter Township of AuSable Zoning Ordinance.  The proposed amendment addresses the following provisions and issues:

                ∙Definitions related to Marihuana Establishments (Adult-Use Recreational Marihuana Establishments as regulated by the Michigan Regulation and Taxation of Marihuana Act, MCL 333.27951 et seq.) would be added to Article 2 (“Definitions”) of the Zoning Ordinance.  Definitions would be added for the following terms: “Marihuana or Marijuana”; “Marihuana Establishment”; “Marihuana Grower”; “Marihuana Processor”;  “Marihuana Retailer”; “Marihuana Safety Compliance Facility”; “Marihuana Secure Transporter”; “Licensee”; and “Person.”

                ∙Article 4 (“District Regulations”) would be amended to show that a marihuana retailer (as an adult-use recreational marihuana establishment) is included in the list of land uses permitted by special use approval in the C-1, C-2, and C-3 zoning districts.

                ∙Article 7 (“Supplemental Regulations”) would be amended to describe the requirements and conditions that an applicant must satisfy when applying to the Township Planning Commission for a special land use permit for operating an adult-use recreational marihuana establishment in the C-1, C-2, or C-3 zoning district in the Township.

                ∙Article 3 (“General Provision”), Section 3.22 (“Nonconforming Uses, Structures & Lots”) would be amended to address the subject of nonconforming uses, structures, and lots in relation to adult-use recreational marihuana establishments.

                Please note that the Charter Township of AuSable Board of Trustees will at a later date consider adopting a regulatory ordinance pursuant to the Michigan Regulation and Taxation of Marihuana Act, in connection with the adoption of the above-described proposed amendment to the Charter Township of AuSable Zoning Ordinance, which, if adopted, would authorize a limited number and type of adult-use recreational marihuana establishments in specified zoning districts in the Township.

The public is invited to attend and participate in the public hearing.  Please be advised that the proposed amendment, as well as the Zoning Ordinance and Zoning Map, may be examined at the Township Hall at the address stated above, Monday through Friday, between the hours of 9:00 a.m. and 5:00 p.m.  Please also be advised that written comments concerning the proposed amendment will be received and considered by the Planning Commission.  Written comments should be provided by either submitting them during the public hearing; delivering them to the Township Hall; or mailing them to the Township Hall at the address stated above for receipt by the time of the public hearing.

The Charter Township of AuSable is in the process of rezoning certain properties to more appropriate zoning districts. You are receiving this letter because your property is proposed for rezoning or is within 300 feet of property that is proposed for rezoning. Please see the enclosed map which shows all property proposed for rezoning.  Please note that the C-1 District is being amended to become a Mixed Use District (rather than a Central Business District). Lots that are already within C-1 will change to the new C-1 District (General Mixed Use District). The new C-1 District will allow residential uses (which will be required to follow the standards of the R-3 District) in addition to all of the previous uses which were allowed under C-1.

 

Please note that zoning designation does not affect property taxes. Property taxes are based on the use actually occurring on the property.

 

The Charter Township of AuSable Planning Commission will hold a public hearing on November 25, 2020 at 6:00 pm to recommend rezoning these properties to the Township Board. The public hearing will be held at the Township Hall at 4420 N. NOTE: Public Act 110 of 2006, as amended, requires notification of properties proposed for rezoning and notification of properties located within 300 feet of those properties. Properties in groups of 11 or more adjacent parcels that are proposed for rezoning are exempt from these notification requirements.
